The 11th Circuit, in specifically stating that the court cannot write a law or invoke privilege after-the-fact, looks to be heading off another round of specious legal arguments from the Clown Show (arguments that Cannon should have rejected).
There's not much wiggle room. The 11th Circuit's ruling means:
Zero possessory interest.
No applicable executive privilege.
No applicable attorney/client privilege.
He can't claim magical declassification or possession.
Furthermore: - Attorneys (Bobb, Corcoran) who signed statement affirming all documents had been returned should be investigated for perjury/ethical misconduct. - Attorneys making 'attorney/client' privilege argument are, themselves, in the crosshairs for ยง793, ยง1519, and ยง2071.
