What law? There are no federal laws that prohibit the use of AI in political ads. About 20 states have adopted laws addressing deepfakes in political advertising; to my knowledge, the only existing law in CA where X is located applies only to ads aired within 60 days of an election. To the extent that other state laws may apply, a candidate might be able to sue for injunctive relief or damages but any damages would be a drop in the bucket for Elmo.

It's not at all clear that Elmo would be considered an "agent" of a candidate. Also, the FEC has a pending petition for rulemaking that requests that the FEC amend this section to make clear that it applies to deliberately deceptive AI campaign ads. Unless and until the FEC rules on this petition, it's not going to be applied to campaign ads created using AI.

I don't believe anyone's ever been deemed to be an agent of a candidate under this statute simply by virtue of endorsing and/or donating to that candidate. And unfortunately, given the number of people who continue to post on the hellsite, I don't have a high degree of confidence in the court of public opinion.
